Griffith Introduces 'State Legislative Veto'

Date: March 31, 2011
Location: Washington, DC

Congressman Morgan Griffith (R-VA) issued the following statement today regarding his recently introduced legislation, H.J. Res 46:

"For too long, states have faced costly federal mandates and burdensome regulations. The states have had no choice but to comply. H.J. Res 46 would empower a supermajority of the states to void any federal law or regulation -- essentially creating a "state legislative veto.' Repeal would require the consensus of two-thirds of state legislatures. If states feel a certain law or executive branch regulation is too onerous, they ought to be able to override Washington.

"Article V of the Constitution allows two-thirds of state legislatures to propose changes to the Constitution by way of a Convention. Since that mechanism exists for changes to the Constitution, why shouldn't states have a weapon regarding overreaching federal laws and regulations?"
