Malliotakis Introduces Transparency of Migration Act

Congresswoman Nicole Malliotakis (NY-11), yesterday led her colleagues Reps. Carlos Gimenez (FL-26), Glenn Grothman, (WI-06), Jody Hice (GA-10), Greg Steube (FL-17) and Randy Weber (TX-14) in introducing H.R.4096, the Transparency of Migration Act, legislation that requires the Department of Homeland Security (DHS) and the Department of Health and Human Services (HHS) to make certain information relating to individuals processed through or apprehended by Custom and Border Protection (CBP) or HHS facilities publicly available on department websites.

"By reversing President Trump's immigration policies, the Biden Administration has created a humanitarian crisis at our southern border while at the same time releasing thousands of illegal immigrants, smugglers and convicted felons into communities throughout our nation, often with federally funded transportation to their final destination," said Congresswoman Malliotakis. "We are seeing the highest numbers of illegal border crossings in CBP history, including thousands of unaccompanied children (UAC) smuggled across our border every month. My bill aims to hold the Administration accountable by demanding transparency as to how many migrants have been apprehended at the border, processed through government holding facilities or released into the United States, along with their countries of origin and criminal records."

In April, Malliotakis visited the southern border, met with CBP officers and toured the Donna Migrant Processing Facility to see firsthand the devastating national security, humanitarian, and health crisis caused by an unprecedented surge in border crossings.

Malliotakis added: "One of the major complaints from local officials is they don't know who is being sent to their districts or if the individuals being sent pose a public safety, public health or national security risk. State and local governments deserve to know who is being sent to their communities so they can direct the proper resources, anticipate the impact on local services, protect residents and hold the Biden Administration accountable for its failure to address this crisis. "

Malliotakis' bill specifically requires DHS and HHS to publish the following information on department websites on a weekly basis:

The daily number of individuals apprehended by CBP, processed through HHS facilities or released into the United States
The individuals' countries of origin
The individuals' ages & genders
The states to which such individuals have been either released or sent
The number and types of criminal convictions should an individual have a criminal record.
