Title: Requires the Department of Public Safety to Cooperate with Federal Immigration Officials

Vote to override the governor's veto of a bill that requires the North Carolina Department of Public Safety to Cooperate with Federal Immigration Officials.

Highlights:

  • Requires the Secretary of the Department of Public Safety, the Secretary of the Department of Adult Correction, the Commander of the State Highway Patrol, and the Director of the State Bureau of Investigation to do each of the following (Sec. 1):

    • Enter into a Memorandum of Agreement (MOA) with the Director of U.S. Immigration and Customs Enforcement (ICE) to allow state law enforcement officers to perform immigration law enforcement functions;

    • Develop departmental policies requiring employees to attempt to determine the immigration status of individuals in custody and inquire/report to ICE when citizenship or legal residency cannot be determined;

    • Cooperate with ICE to the fullest extent allowed by law; and

    • Report the MOA and departmental policies required by this section to the Joint Legislative Oversight Committee on Justice and Public Safety.

  • Requires the State Auditor to perform an audit to determine the compliance of each state agency with the requirements of this section (Sec. 1).

  • Requires the Department of Health and Human Services (DHHS) to take all steps necessary to cease providing state-funded benefits to noncitizens without legal residence in the U.S. (Sec. 2).

  • Requires DHHS to report to the Joint Legislative Oversight Committee on Health and Human Services and the Fiscal Research Division all steps taken to implement this section (Sec. 2).

  • Requires the Department of Commerce, the Housing Finance Agency, and all local housing authorities to take all steps necessary to cease providing publicly funded housing benefits to noncitizens without legal residence in the U.S. (Sec. 3).

  • Requires those entities to report to the Joint Legislative Commission on Governmental Operations and the Fiscal Research Division all steps taken to implement this section (Sec. 3).

  • Requires the Department of Commerce Division of Employment Security to verify that all applicants for unemployment benefits are legal residents of the U.S. (Sec. 4).

  • Exempts any county that violates the prohibition against sanctuary ordinances from governmental immunity, and waives a county’s immunity from civil liability for crimes committed by an unauthorized immigrant (Sec. 5).

  • Prohibits any constituency from adopting any sanctuary policies (Sec. 6).

  • Specifies that this act takes effect upon passage (Sec. 7).
