Title: Requires Consent Verification for Pornographic Website Uploads

Vote to pass a bill that requires consent verification for pornographic website uploads in California.

Highlights:

  • Requires an operator of a pornographic internet website to exercise care and diligence to ensure that each instance of sexually explicit content displayed on the website was created and uploaded consensually and does not involve a minor (Sec. 1).

  • Requires a user of a pornographic website to submit a statement certifying the following, under penalty of perjury, before uploading sexually explicit content to the site (Sec. 1):

    • That the individual was not a minor at the time that the content was created;

    • That the individual consents to the content being uploaded; and

    • That the individual consented to being depicted in the content.

  • Classifies providing false information in the statement described above as a criminal infraction punishable by a fine of $1,000 (Sec. 1).

  • Authorizes an individual depicted in sexually explicit content who suffers harm as a result of a violation of this act to bring civil action against the operator of the pornographic website or the user who uploaded the content (Sec. 1).

  • Exempts sexually explicit content sent on an online dating service through a private message (Sec. 1).
