Vote to pass a bill that prohibits governmental entities from partnering, funding, or receiving payment from private detention facilities in Delaware.

Highlights:

• Prohibits the State, a local unit of government, or any agency, officer, employee, or agent thereof, from doing any of the following (Sec. 2):

• Entering into an agreement for the detention of an individual in a private detention facility;

• Paying, reimbursing, subsidizing, or defraying any cost for the sale, purchase, construction, or operation of a private detention facility;

• Receiving per diem, per detainee, or any other payment related to the detention of an individual in a private detention facility; or

• Giving any financial incentive or benefit to any private entity or person in connection with the sale, purchase, construction, or operation of a private detention facility.

• Specifies that this section does not prohibit the state or a local unit of government from contracting with a private entity for certain services in a public detention facility (Sec. 2).
