Title: Establishes the Crime of Second Degree Cruelty to the Elderly and Individuals with Infirmities
Vote to concur with Senate amendments and pass a bill that establishes the crime of second degree cruelty to the elderly and individuals with infirmities in Louisiana.
Expands the list of offenses that qualify as crimes of violence to include second degree cruelty to the elderly and persons with infirmities (Sec. 2).
Expands the definitions of first and second degree murder to include the killing of a person while perpetrating second degree cruelty to the elderly and persons with infirmities (Sec. 30).
Expands the definition of first degree murder to include the killing of a person while violating parole or while illegally possessing a firearm (Sec. 30).
Defines “second degree cruelty to the elderly and persons with infirmities” as intentional or criminally negligent mistreatment or neglect which causes serious bodily injury to a person with an infirmity, an adult with a disability, or a person who is elderly, including individuals in resident facilities (Sec. 93).
Establishes the punishment for the crime of second degree cruelty to the elderly and persons with infirmities as imprisonment with hard labor for up to 40 years (Sec. 93).
