Title: Authorizes the Construction of Accessory Dwelling Units Without Municipal Approval
Vote to pass a bill that authorizes the construction of accessory dwelling units without municipal approval in Pennsylvania.
Defines “accessory dwelling unit” as a residential living unit on a parcel where a residential building is present or may be constructed, that provides complete independent living facilities, excluding recreational vehicles (Sec. 1).
Requires municipalities with residential zoning to permit one accessory dwelling unit per lot as a use by right, and specifies that this permit does not supersede deed restrictions, covenants, or planned community documents (Sec. 1).
Specifies that accessory dwelling units may be attached to, or located within, an existing or proposed residential building, or detached from the residential building if located on the same lot (Sec. 1).
Prohibits municipalities from imposing the following requirements on accessory dwelling units (Sec. 1):
A minimum net floor area exceeding 200 square feet;
A maximum net floor area below 50% of the primary structure or 850 square feet, whichever is less;
A height limit below 25 feet or at the height of the residential building, whichever is less;
Additional off-street parking or replacement of demolished parking spaces;
Owner-occupancy or familial relationship requirements;
Stormwater or water quality standards more restrictive than those applied to the primary residential building;
Architectural or design standards more restrictive than those applied to the primary residential building;
Fire sprinkler requirements not also required of the primary residential building; or
Setbacks greater than 4 feet from side and rear lot lines for newly constructed units.
Allows municipalities to prohibit short-term rentals of accessory dwelling units for periods of fewer than 30 consecutive days (Sec. 1).
Specifies that this Act takes effect 60 days after passage (Sec. 2).
