Vote Smart's Synopsis:

Vote to pass a bill that requires adult-content platforms to use age verification to prevent traffic by minors in Iowa.

Highlights:

• Prohibits a person from operating an internet site, application, or social media platform that contains a substantial portion of pornographic content unless the person uses reasonable age verification to prevent minors from accessing such content (Sec. 2).

• Establishes the following acceptable measures for age verification (Sec. 2):

• Requiring an individual to provide digital identification;

• Establishing a method that is commercially reasonable and uses transactional data to verify an individual’s age; or

• A method approved by the attorney general.

• Prohibits the retainment, sale, leasing, or dissemination of identifying information of an individual subject to age verification (Sec. 2).

• Exempts public interest broadcasters, news gathering organizations, and internet service providers from this verification requirement (Sec. 3).

• Authorizes the attorney general to enforce this law, seek injunctions for violations, and bring actions against violators of this law (Sec. 4).

• Establishes that each time an individual accesses an internet site in violation of this law, it will constitute a separate offense (Sec. 4).

• Establishes a civil penalty of this violation up to one thousand dollars per violation with a limit of ten thousand dollars in a single day (Sec. 4).

• Requires that civil penalties collected under this law be deposited into the general fund of the state (Sec. 4).

• Authorizes the attorney general to adopt rules to administer this law (Sec. 5).

• Specifies that this law is to take effect June 19, 2026 (Sec. 5).
