Title: Establishes an Administrative Process for Settling Conflicts Between Home Owner's Associations and Property Owners
Vote to amend and pass a bill that establishes an administrative process for settling conflicts between Home Owners Associations and property owners in Georgia.
Prohibits individuals to operate an owner’s association in Georgia without registration (Sec. 2).
Restricts any owner’s association or agent from collecting fines or fees against any owner, or filing a foreclosure against any lot unless the owner’s association is registered under this Code (Sec. 2).
Requires the owner’s association to register the correct forms to the Secretary of State, including the following information (Sec. 2):
The name, address, and officers of the owner’s association; and
A financial statement of the owner’s association dated no more than one year prior to filing.
Requires a renewal of each registration on December 31 of each year and requires a renewal fee of $100.00 (Sec. 2).
Authorizes those residing in an owner's development to file a complaint with the Secretary of State (Sec. 2).
Authorizes owners to have the right to inspect and obtain copies of owner’s association records, obtain copies of their certificates, attend meetings, challenge discriminatory practices, and to expect directors to disclose any conflicting interests with respect to a transaction (Sec. 2).
Requires a vote to determine whether the provisions of the mortgages permitted will go into effect requiring more than 80% of the voting interest (Sec. 4).
Specifies that this Act applies to any association of owners and that each association is subject to a recorded declaration of covenants of property (Sec. 6).
Specifies a requirement to attend court depending on the circumstances of owner’s associations and the individuals (Sec. 7).
Specifies that this Act takes effect January 1, 2027, with the exception of Section 7, which will become effective on July 1, 2026 (Sec. 9).
Requires all laws and parts of laws in conflict with this Act to be repealed (Sec. 10).
