Vote to amend and pass a bill that establishes regulations on counterfeit intimate images in Utah.

Highlights:

• Requires any generated image requests through servers or computer systems to be controlled by the service operator rather than on the local drive of an individual (Sec. 2).

• Prohibits any intimate visual depiction of an individual in generated images (Sec. 2).

• Prohibits the distribution of non-consensual intimate images generated by artificial intelligence (Sec. 3).

• Authorizes a person or heirs of a deceased person to seek civil action against a generation service that violated this act (Sec. 4). 

• Specifies that the statute of limitation for civil action is 3 years from the date of plaintiff discovery or 10 years from the date of the violation (Sec. 4).

• Requires generation services to take reasonable steps to inform users of the prohibition of non-consensual image generation and notify that violation may result in civil liability (Sec. 7).

• Prohibits the distribution of non-consensual counterfeit intimate images (Sec. 8).

• Requires platforms to establish and implement notice and removal procedures for counterfeit intimate images (Sec. 9).

• Specifies that this act is effective on January 1, 2027 (Sec. 21).
