Vote to pass a bill that prohibits law enforcement officers in Virginia from wearing face coverings, with certain exemptions.

Highlights:

• Prohibits any law-enforcement officer from wearing a facial covering while engaged in the performance of their official duties (Sec. 1).

• Defines “facial covering” as any worn item which hides a substantial portion of the face to conceal the identity of the wearer (Sec. 1).

• Exempts the following from the prohibition established under this section (Sec. 1):

• A translucent face shield or clear mask that does not conceal the wearer’s identity;

• An N95 medical mask or surgical mask worn to protect against disease or infection;

• A device necessary to protect against exposure to any toxin, gas, smoke, inclement weather, or other hazardous conditions;

• A device necessary for underwater use;

• A motorcycle helmet when using a motorcycle or other similar vehicle;

• Protective eyewear;

• A facial covering used by an officer assigned to a special weapons and tactics (SWAT) team or other specialized tactical unit; and

• A facial covering used by an officer assigned to an undercover or surveillance unit where the protection of the officer’s identity is determined necessary by the Department of Criminal Justice Services.

• Classifies a violation of this section as a Class 1 misdemeanor (Sec. 1).
