Title: Prohibits the Use of Mobile Electronic Devices While Driving
Vote to pass a bill that prohibits the use of mobile electronic devices while driving in Kentucky.
Defines “mobile electronic device” as a cell phone, portable computer, GPS receiver, electronic game, or any substantially similar device (Sec. 1).
Specifies that the definition of mobile electronic device does not include various forms of radios, subscription based emergency communication devices, or a prescribed medical device (Sec. 1).
Prohibits individuals from doing any of the following while operating a motor vehicle on any public highway in Kentucky (Sec. 1):
Holding or supporting a mobile electronic device, except for an earpiece or wrist-worn device;
Reading, composing, or transmitting any text, including messages, emails, and application or website interactions on a mobile electronic device; or
Watching videos or taking video calls on a mobile electronic device.
Exempts the following from the prohibition described above (Sec. 1):
Using a mobile electronic device in a motor vehicle that is parked or stopped;
Initiating a voice-based text without holding or supporting the device;
Reporting an accident, emergency, or safety hazard to a public safety official;
Using a digital dispatch system while working;
Performing official duties as a first responder;
Using navigation or taking phone calls without holding or supporting the device; or
Using equipment installed by the original manufacturer of the vehicle.
Prohibits peace officers from doing any of the following solely based on a suspected violation of this section (Sec. 1):
Stopping an individual without visually observing a violation;
Seizing, searching, viewing, or requiring forfeiture of a mobile electronic device;
Searching or requesting to search a vehicle, operator, or passenger; or
Making a custodial arrest.
Requires the Transportation Cabinet to install signage advising drivers of this section at every entry point to and at various points on state highways (Sec. 1).
Establishes a fine of $100 for a violation of this Act (Sec. 3).
Specifies that a violation of this Act shall not result in points against the driving record of any person convicted (Sec. 3).
Requires peace officers to issue courtesy warnings for violations of this Act until October 31, 2026 (Sec. 5).
