Vote Smart's Synopsis:

Vote to pass a bill that expands requirements for state and local government entities to cooperate with federal immigration enforcement in Indiana.

Highlights:

• Prohibits state and local governments from limiting or restricting the enforcement of federal immigration law (Sec. 4).

• Authorizes the governor to withhold grant or state funding for any government body that fails to do the following (Sec. 4.):

• Provide to an authorized judge notice that an individual is subject to an immigration detainer request;

• Record the individual’s case file that the individual is subject to an immigration detainer request;

• Comply with all requests made in the immigration detainer request; and

• Inform the individual that they are being held in pursuit of a detainer request issued by an immigration officer.

• Requires notified judges to record the notification of the presence of an immigration detainer to the court’s records regardless of whether the notice was received before or after judgement of the case (Sec. 8).

• Prohibits employers from knowingly employing an undocumented immigrant, and establishes civil liability for violation (Sec. 11).

• Specifies that this Act be effective July 1, 2026 (Sec. 1).
