Title: Establishes Limitations on Intercollegiate Athlete Name, Image, and Likeness (NIL) Contracts and Amends Appropriations and Regulations for the State Budget
Vote to concur with Senate amendments and pass a bill that establishes limitations on intercollegiate athlete name, image, and likeness (NIL) contracts, and amends appropriations and regulations for the Ohio state budget.
Prohibits any person from entering into a contract with an intercollegiate athlete that compensates the athlete for their name, image, or likeness (NIL) if it remains in effect after the athlete’s intercollegiate athletic eligibility ends (Sec. 1).
Prohibits any person from entering into an NIL contract with an athlete if it requires any litigation, arbitration, or other dispute resolution process to occur in another state (Sec. 1).
Requires a contract that provides compensation to an athlete for their NIL to require any litigation, arbitration, or other dispute resolution process to take place in Ohio and be governed by Ohio law (Sec. 1).
Requires the parties to any NIL contract involving an athlete who transfers to an Ohio institution from another state to ensure that the contract continues at the new institution (Sec. 1).
Prohibits an athlete agent from entering into a fee agreement that requires an athlete to provide future compensation or NIL rights after the athlete’s intercollegiate athletic eligibility ends (Sec. 1).
Prohibits an athlete agent from entering into an agent contract under which they represent an athlete on legal matters regarding the use of their NIL after the athlete’s intercollegiate athletic eligibility ends (Sec. 1).
Specifies that NIL includes personal services included in a contract involving skill or talent based performance by the student-athlete (Sec. 1).
Specifies that this Act applies to contracts and agreements entered into on or after its effective date (Sec. 1).
Establishes various provisions related to the state budget, including the following appropriations and regulations regarding funding (Sec. 7-14):
Requires the amount spent on Medicaid quality incentive payments for nursing facilities to be determined based on 60% of the per diem amount a facility’s cost per case-mix unit changed as a result of rebasing, not the change in the facility’s rate for direct care costs;
Establishes regulations regarding education reporting, school transportation, emergency management, arts programs, accelerated college and career pathways, and early childhood education grants;
Establishes regulations regarding fees and licensures under the Department of Public Safety;
Extends the date that the Department of Children and Youth is required to calculate publicly funded child care payments based on enrollment rather than attendance to July 9, 2028;
Appropriates $40 million from the general revenue fund to the Ohio Post-Traumatic Stress Fund for first responders;
Appropriates $17.8 million from the general revenue fund to the One Time Strategic Community Investments Fund; and
Amends funding for various other departments, programs, and improvements.
