Vote to concur with Senate amendments and pass a bill that requires food delivery platforms to refund undelivered or incorrect orders and prohibits using tips to offset the drivers' base pay in California.

Highlights:

• Defines “terms of service” as a set of policies that specify what user behavior and activities are permissible on an internet-based service, including but not limited to user agreements, community guidelines, content moderation guidelines, and acceptable uses (Sec. 22675f).

• Requires social media companies to post terms of service for each social media platform owned or operated by the company in an easily accessible and understandable format for users, and must include the following (Sec. 22676):

• Contact information for user inquiries on the terms of service;

• A description of the process for flagging content, groups, and users in violation of the terms of service; and

• A list of potential actions the company may take against users, such as banning or demonetization.

• Requires social media companies to submit quarterly reports to the Attorney General, which include the most recent terms of service, the amount of flagged content and the categories it falls under, and the actions the company took against such content (Sec. 22677).

• Establishes a civil penalty of a maximum of $15,000 per day for social media companies in violation of these provisions (Sec. 22678a).
