Title: Amends Penalties and Processes for Assessing Penalties Under the Illinois Wage Payment and Collection Act
Vote to pass a bill that amends penalties and processes for assessing penalties under the Illinois Wage Payment and Collection Act.
Specifies that the final decision of the Department of Labor in a wage claim case qualifies as a debt to the state which may be collected using all methods available by law (Sec. 11).
Specifies that the monthly penalty of 5% and the daily penalty of 1% for damages of unpaid wages will accrue until the date that the final order and decision of the Department of Labor becomes a debt to the state (Sec. 14).
Increases the administrative fee due to the Department of Labor for unpaid wage rulings to the following amounts (Sec. 14):
$500 if the unpaid wages owed total $3,000 or less;
$750 if the unpaid wages owed total between $3,000 and $10,000; and
And $1,250 if the unpaid wages owed total more than $10,000.
Specifies that procedural change to prior law affected by this Act will be applied retroactively, and substantive change to prior law affected by this Act will only be applied prospectively (Sec. 20).
