Vote to pass a bill that prohibits and criminalizes the possession or distribution of Kratom.

Highlights:

• Prohibits and criminalizes the possession or distribution of Kratom (Sec. 1).

• Specifies any individual manufacturer or distributor with an amount of Kratom of (Sec. 1):

• An aggregate weight of less than 500 grams shall be fined not more than $50,000 or imprisoned, with or without hard labor for not less than one year nor more than 3 years, or both;

• An aggregate weight of 500 grams or more shall be fined not more than $50,000 or imprisoned, with or without hard labor for not less than one year nor more than 5 years, or both.

• Specifies that any individual found in possession of the following amount of Kratom shall, upon first conviction (Sec. 1):

• Be fined not more than $100 if found in possession of 20 grams or less;

• Be fined not more than $500 or imprisoned for 6 months or both if found in possession of 20 grams or more.

• Specifies that upon second or subsequent conviction, when the offender has 20 grams or more in their possession, to be fined not more than $1,000 or imprisoned for not more than 6 months or both (Sec. 1).

• Specifies that the provisions of this bill shall take effect immediately upon passage and approval by the Governor (Sec. 2).
