Title: Amends Terms of Imprisonment for Misdemeanors
Vote to adopt a conference report and pass a bill that amends terms of imprisonment for misdemeanors in Indiana.
Amends terms of imprisonment for misdemeanors in Indiana (Sec. 1-24).
Prohibits local governments from hosting or funding “obscene” performances and the ability for “anyone” to sue a local entity they believe violates the language (Sec. 1-24).
Limits the total of the consecutive terms of imprisonment to which a defendant is sentenced for misdemeanor convictions arising out of an episode of criminal conduct (Sec. 1-24).
Establishes that depositing or causing or allowing the deposit of contaminants or solid waste upon land is a Class C misdemeanor in certain circumstances and makes it a sentencing aggravator that (Sec. 1-24):
The individual is in the United States unlawfully; or
An individual distributed a controlled substance to at least three different individuals in 180 days.
Specifies that it is a sentencing mitigator for certain controlled substance offenses that the person sought and completed treatment for a substance use disorder (Sec. 1-24):
In the year before the commission of the offense; or
After committing the offense and before sentencing.
Specifies that a governmental entity may not organize or host an obscene performance or fund an obscene performance using public funds, and authorizes a person to seek injunctive relief as a remedy for a violation (Sec. 1-24).
Increases the penalty for resisting law enforcement under certain circumstances. Replaces the term "child pornography" with the term "child sex abuse material" throughout the Indiana Code (Sec. 1-24).
Amends certain provisions concerning juvenile court jurisdiction retroactively (Sec. 1-24).
Specifies that a facility having custody of a person arrested for certain crimes may not release the person on bail for at least 24 hours.
Authorizes virtual bail hearings (Sec. 1-24).
Specifies that the provisions of this bill shall take effect beginning July 1, 2025 (Sec. 25).
