Title: Prohibits Health Insurers from Using or Relying on Artificial Intelligence to Deny a Request for Prior Authorization
Vote to pass a bill that prohibits health insurers from using or relying on artificial intelligence (AI) to deny a request for prior authorization, or limit the amount of coverage provided for previously approved care in Nevada.
Prohibits certain health insurers, including insurance for public employees, from using, employing, or relying upon an artificial intelligence system or an automated decision tool to (Sec. 1-12):
Deny a request for prior authorization for medical or dental care;
Modify a request for prior authorization for such care submitted by a provider of health care;
Reduce the scope of services or amount of coverage for such care that is included within a request for prior authorization; or
Terminate, reduce, or modify coverage for previously approved medical or dental care.
Requires that such health insurers approve a request for prior authorization for medical or dental care that is covered by the insurer, unless a licensed health care professional with the education, training, and expertise necessary to evaluate the condition at issue determines that the care requested is not medically necessary or is experimental or investigational (Sec. 1-12).
Amends and makes conforming changes to clarify that certain provisions are generally applicable to members of plans of self-insurance for employees of local governments, and are applicable (Sec. 1-12).
Requires a physician, physician assistant, advanced practice registered nurse or an osteopathic physician to (Sec. 1-12):
Discuss with a patient, upon diagnosing the patient with arthritis, osteoarthritis or any other condition that is regularly treated using stem cell therapy, the potential use of stem cell therapy to treat the condition; and
When acting as a provider of primary care during the first encounter with a new patient, inform the patient of options that may be available to the patient for donating, banking, or storing stem cells for future use by the patient or a donee.
Specifies that the provisions of this bill shall become effective immediately upon passage and approval by the Governor (Sec. 13).
