Highlights:

• Amends the definition of rape to specify that an individual is a victim if they are under the age of 18, rather than 16, in Oklahoma (Sec. 1). 

• Specifies that rape is an act of sexual intercourse in which any of the following circumstances apply (Sec. 1):

• The victim is under 18 years of age;

• The victim is incapable of giving consent due to mental illness or unsoundness of mind;

• Force or violence is used;

• The victim is intoxicated by a narcotic or anesthetic agent;

• The victim is unconscious;

• The victim submits to sexual intercourse under the belief that the person committing the act is a spouse;

• The victim is under legal custody of a government agency and engages in sexual intercourse with an employee of the agency;

• The victim is a student between the ages of 16 and 20 and engages in sexual intercourse with an employee of their school who is over the age of 18;

• The victim is under the age of 19 and engages in sexual intercourse with a foster parent; or

• The victim is a secondary school student, is enrolled at an institution of higher education, and engages in sexual intercourse with an employee of the institution of higher education.

• Specifies that an individual may not be convicted of rape on account of sexual intercourse with anyone 16 years of age or older, unless the person was more than four years older than the other person at the time of the act (Sec. 2).
