Title: Reduces Lot Size Requirements and Local Controls for Housing Development Projects
Vote to pass a bill that reduces the lot size requirement and local controls for new housing development projects in Arizona.
Prohibits municipalities from interfering with a home buyer’s right to choose (Sec. 9-461.19):
Features;
Amenities;
Structures;
Floor plan; and
Interior and exterior design of a home.
Prohibits municipalities from requiring (Sec. 9-461.19):
Shared features or amenities that would require a homeowners’ association; and
Screening, walls, or fences on residential property.
Specifies that the provisions of this bill regarding buyer’s right does not apply to (Sec. 9-461.19):
Applicable building, fire, or public health codes; and
Lots or parcels that are located on tribal lands.
Prohibits municipalities from adopting or enforcing any code, regulation, or other legal requirement that establishes any of the following (Sec. 9-461.20):
Minimum lot sizes that are more than 3,000 square feet;
Minimum square footage or dimensions for a single-family home;
Minimum or maximum lot coverage for a single-family home;
Minimum building setbacks for single-family homes that are more than 5 feet from the side lot lines and 10 feet from the front and rear lot lines; and
Design, architectural, or aesthetic elements for a single-family home that is not in a district of historical significance.
Specifies that the provisions of this bill regarding regulations do not apply to (Sec. 9-461.20):
Applicable building codes, fire codes, or utility clearance requirements; and
Lots or parcels of land on tribal lands.
Authorizes municipalities to require the construction of or payment for necessary public services needed to serve the new single-family homes in accordance with state statutes (Sec. 9-461.20).
Specifies that the provisions of this bill are applicable to houses built following the effective date of this bill within municipalities with a population of 70,000 or more (Sec. 9-461.20).
