Title: Establishes Immunity for Drug Overdose Reporting
Vote to concur with House amendments and pass a bill that establishes immunity for drug overdose reporting in Wyoming.
Specifies a person who in good faith, seeks medical assistance for himself or another person has immunity from criminal prosecution for an offense of this section if (Sec. 1):
This person reasonably believes he or another person is experiencing a drug overdose event; (Sect.1)
The person describes the actual location of the drug overdose event;
The person remains at the scene until a responding law enforcement officer or emergency medical service provider arrives or the person remains at the medical care facility where the person experiencing the drug overdose event is located until a responding law enforcement officer arrives;
The person cooperates with the responding personnel, including providing information about the person experiencing the drug overdose and the substance that may have caused the drug overdose; and
The offense comes from the same course of events as the drug overdose event.
Specifies that immunity from prosecution shall apply to the following offenses (Sec. 1):
Possession of a controlled substance; or
Use of a controlled substance.
Specifies that a person experiencing a drug overdose may only receive immunity from prosecution 2 times in 12 months, requires that the person seek a drug treatment program to be eligible for the 2 times in the 12 months (Sec. 1).
