Title: Amends and Modifies Provisions Relating to Fireworks Protections

Vote to pass a bill that amends and modifies provisions relating to fireworks protections in Missouri.

Highlights:

  • Amends and modifies provisions relating to the classification of fireworks based on their chemical composition and effects to be in accordance with the following American Pyrotechnics Association (APA) standards in Missouri (Sec. 320.106):

    • APA 87-1A relating to consumer fireworks;

    • APA 87-1B relating to display fireworks; and

    • APA 87-1C relating to entertainment and technical pyrotechnics.

  • Defines “consumer fireworks” as explosive and pyrotechnic devices designed for sale and use by the general public that (Sec. 320.106):

    • Conform with requirements set forth by the United States Consumer Product Safety Commission (CPSC); and

    • Are designed to produce visible or audible effects by combustion.

  • Specifies that only holders of a state-issued manufacturer or distributor permit shall be allowed to sell consumer fireworks (Sec. 320.126). 

  • Defines “outdoor fireworks display” as a presentation of fireworks before a public audience in accordance with the guidelines established by the National Fire Protection Association (NFPA) (Sec. 320.106). 

  • Authorizes state fire marshalls to grant permits for outdoor fireworks displays to municipalities, fair associations, amusement parks, organizations, persons, firms, or corporations, provided that applications are submitted at least 10 days before the event (Sec. 320.127). 

  • Authorizes state fire marshalls to revoke any permit or license issued to a holder who has willfully violated the provisions of this bill (Sec. 320.116).
