Vote to concur and pass a bill that establishes greater consumer protections for online ticket sales and defend consumers against ticket scalpers and resellers in Colorado.

Highlights:

• Specifies that “venue” does not include a movie theater (Sec. 1.II). 

• Redefines “resellers” as an operator or a reseller from which a purchaser bought a ticket shall provide a full refund of the ticket price (Sec. 1.2). 

• Specifies that a ticket could be purchased and not provide admission to the event except nonadmission to the event due to an act or omission by the purchaser (Sec. 1.2B). 

• Specifies a contractual right that gives the purchaser priority for subsequent season ticket packages with the operator or the following, (Sec. 1.3):

• The ticket to a place of entertainment if the ticket was initially offered; 

• At no charge and access to the ticket is not contingent upon providing any form of monetary consideration; 

• On behalf of a charitable organization where all proceeds from the ticket sale are provided to the charitable organization;

• Specifies that selling a ticket to an event at a place of entertainment without disclosing the total ticket cost including all fees, the first time price is displayed to the purchaser and anytime after (Sec. 2D).

• Authorizes that a person is not required to include the amount of any sales tax required to purchase a ticket when disclosing the total cost to a purchaser if the person discloses the amount of any sales tax prior to the completion of the transaction (Sec. 2 II). 

• Authorizes that when one sells a ticket to an event without disclosing the portion of the ticket cost that represents a service charge for the purchase (Sec. 2F). 

• Authorizes that the purchaser of the ticket must be presented with subtotals, fees, charges, or any other component of the total price of the ticket or increases in the total price of a ticket prior to the completion of the transaction by the purchaser (Sec. 2H). 

• Authorizes any additional applicable sales tax of a ticket price prior to the completion of the transaction (Sec. 2I). 

• Authorizes additional fees for the delivery of non-electronic tickets based on the delivery to the purchaser's address or delivery method if the person discloses the amount of each delivery fee and may increase the price of a ticket if the purchaser's transaction period has timed out (Sec. 2I). 

• Defines “internet domain name” as a globally unique hierarchical reference to an internet host or service that is assigned through a centralized internet naming authority and composed of a series of character strings separated by periods with the rightmost string specifying the top of the hierarchy (Sec. 2.2).
