Vote to pass a bill that requires generative AI systems that average 1 million monthly visitors or users to provide an "AI detection tool" that would verify whether content was generated by the system in California.

Highlights:

• Defines a covered provider as a person who develops a generative artificial intelligence (AI) system that has over 1,000,000 monthly users and is publicly accessible within the geographic boundaries of the state (Sec. 22757, Ch. 25).

• Requires a covered provider to make available an artificial intelligence (AI) detection tool that is publicly accessible through the covered provider’s internet website and mobile applications, if they have them (Sec. 22757, Ch. 25).

• Requires a covered provider to give the user an option to include a manifest disclosure in digital content created or altered by the provider’s generative AI system that clearly identifies digital content as made using AI (Sec. 22757, Ch. 25).

• Requires a covered provider to include a latent disclosure in AI-generated digital content containing the name of the provider, name and version of the AI, time and date that the content was generated, a unique identifier, and what parts of the content were created or altered by AI either directly or through a link to a website (Sec. 22757, Ch. 25).

• Requires a covered provider to revoke the license of a third-party licensee within 72 upon learning of the licensee’s action if the licensee modifies a generative AI system such that it is no longer capable of providing the proper disclosure information in digital content it creates or alters (Sec. 22757, Ch. 25).

• Establishes a $5,000 civil penalty fee per violation for covered providers that violate the terms of the bill (Sec. 22757, Ch. 25).

• Authorizes the Attorney General, a county counsel, or a civil attorney to bring a civil action for injunctive relief and reasonable attorney’s fees and costs for a third-party licensee that continues using the generative AI system after their license has been revoked (Sec. 22757, Ch. 25).
